J U D G M E N T
The issue pertains to the steps taken by a cooperative society for amendment of the bye-laws with regard to collection of legal fees from the loan applicants. The stand taken by the Government is that the same is in violation of circular No.8/94. According to the petitioner, circular No.8/94 is of no consequence in view of the the judgment in O.P.No.7457/94. Apparently, no reference is made in Ext.P4 on the said judgment. I quash Ext.P4 as far as the amendment of additional clause 51B is concerned, with a direction to consider the matter afresh with notice to the petitioner and pass a fresh order, in the light of the judgment referred to above, within four months from the date of production of a copy of this judgment along with a copy of the judgment referred to above. The writ petition is disposed of as above.
