ORDERPetitioner, who is the second accused in Crime No.490 of 2006 of Neyyattinkara Police Station for offences punishable under Sections 120B, 367 and 395 I.P.C., seeks his enlargement on bail. He was arrested on 22.10.2006.
2. The case of the prosecution is that the petitioner along with the other accused had kidnapped the husband of the de facto complainant and robbed him of his cash and other belongings including a Mobile Phone, Motor Cycle, etc. and had also demanded ransom from his wife. The learned Public Prosecutor submitted that the petitioner was an accused in the Bishop House attack case involving an offence punishable under Section 307 I.P.C. The petitioner violated the bail condition imposed by the court and had committed a crime in another case registered as Crime No.367 of 2006 of Neyyattinikara Police Station. Such a person will not only influence the prosecution BA 39/07 -: 2 :- witnesses but will also flee from justice. I am not inclined to grant bail to the petitioner.
