J.B.KOSHY & T.R.RAMACHANDRAN NAIR, JJ.W.P.(C).NO. 8093 OF 2007
Dated this the 29th day of March, 2007.
Koshy, J.This is a petition for police protection to stop the illegal and unauthorised functioning of the pig farm of the third respondent and also for implementing the direction of this court. If the direction of this court in Ext.P3 is violated, petitioner is free to file contempt petition. According to the third respondent, now he is not conducting any pig farm. There is only one pig and there is no violation of the judgment, as there is no pig farming. On behalf of police as well as Grama Panchayath it was submitted that there is no licence and he is only having one pig and this is a factual aspect. As he is only having one pig, no police interference is required. However, if the third respondent is actually conducting pig farm, petitioner is free to approach statutory authorities and if Ext.P3 is violated, he is free to approach the court for contempt. The Writ Petition is disposed of accordingly.
