The petitioner has produced Ext.P1 Order dated 27.3.2007 passed by the first respondent by which he stands suspended from service. The petitioner has produced Exts.P2,P3 and P4 to contend that statements made in Ext.P1 do not represent the truth and that the petitioner has not committed any illegality or irregularity.
2. The factual aspects will have to be brought to the notice of the first respondent, if the petitioner so feels. Rule 10(6) of the Kerala Civil Services (Classification, Control and Appeal) Rules 1960 empowers the authority, who passed an order of suspension, to revoke the same and reinstate the employee if convinced that the order was passed not in accordance with law or that there was no justification for suspension. Therefore, the petitioner can file a representation before the first respondent W.P.(C)No.11072/2007 :2: under the aforesaid provision. I make it clear that if the petitioner files any such representation, the same shall be considered as a statutory petition and orders passed without delay.
