O R D E RThe revision petitioner stands convicted for the offence under section 138 of the Negotiable Instruments Act and sentenced to undergo simple imprisonment for one month and to pay a sum of Rs.15,000/- as compensation.
2. The revision petitioner has only sought for modification of sentence. In the circumstances, the sentence is modified to imprisonment till rising of the court and to pay a compensation of Rs.15,000/- vide section 357(3) Cr.P.C and in default to undergo simple imprisonment for one month. The revision petitioner shall appear before Judicial First Class Magistrate-II, Nedumangad on 05.05.2007 to receive sentence. Non bailable warrant pending if any shall be kept in abeyance till then. The Crl.R.P is disposed of accordingly.
