Petitioners, who are accused Nos.1 and 2 in Crime No.66/07 of Karukachal Police Station for offences punishable under sections 452, 323 and 326 read with section 34 IPC and subsequently sustained only for section 326 read with section 34 IPC, seek anticipatory bail.

2. Learned Public Prosecutor opposed the application.

3. The occurrence took place on 14.3.07 at 12 noon during which the defacto complainant is alleged to have assaulted with sword stick, iron rod, etc. resulting in injuries including fracture of the 5th metacarpal and a cut injury on his forehead.

4. Anticipatory bail cannot be granted in a case of this nature. But at the same time, I am inclined to permit the petitioners to surrender before the Investigating Officer for interrogation and then to have their application for regular bail considered by the Magistrate having jurisdiction. Accordingly, the petitioners are directed to surrender before the Investigating Officer on any day between 16.4.2007 and 18.4.2007 for the BA.2078/07 purpose of interrogation and recovery of incriminating materials, if any. The petitioners shall, thereafter, be produced on the same day before the Magistrate having jurisdiction, who shall consider and dispose of the application for regular bail, if any, filed by the petitioners, preferably on the same date on which it is filed. This application is disposed of as above.
