Both these applications are for anticipatory bail. The sole petitioner in B.A.No.2068/07 is the first petitioner in B.A.No.2070/07. In B.A.No.2068/07 he is the first accused in Crime No.293/07 of Kollam East Police Station for offences punishable under sections 420, 468, 470, 474 and 120B read with section 149 IPC. In B.A.No.2070/07 the petitioners are accused Nos.1, 4 and 5 in the very same Crime No.293/07 referred to above. In view of the fact that the petitioner in B.A.No.2068/07 is the first petitioner in B.A.No.2070/07 pertaining to the very same crime, the learned counsel for the petitioner submitted that he is not pressing B.A.No.2068/07, which is accordingly dismissed as not pressed.

In the case of B.A.No.2070/07, in as much as the first petitioner has been granted anticipatory bail in two other related crimes and petitioners 2 and 3 are his sister and brother respectively, I see no reason why the petitioners therein should be treated differently. Accordingly, a direction is issued to the officer-in-charge of the police station concerned to release the petitioners on bail for a period of one month in the event of their arrest in connection with the above case on each of them executing a bond for Rs.10,000/- (Rupees ten thousand BA.2068/07 & 2070/07 only) with two solvent sureties each for the like amount to the satisfaction to the said officer and subject to the following conditions:

a. Petitioners 1 and 3 shall report before the Investigating Officer between 9 a.m. and 11 a.m. on all Wednesdays.

b. Petitioners shall make themselves available for interrogation as and when required by the Investigating Officer.

c. Petitioners shall not influence or intimidate the prosecution witnesses nor shall they attempt to tamper with the evidence for the prosecution.

d. Petitioners shall not commit any offence while on bail.

e. Petitioners shall surrender before the Magistrate concerned and seek regular bail in the meanwhile. If the petitioners commit breach of any of the above conditions, the bail granted to them shall be liable to be cancelled. These applications are allowed as above.
