J U D G M E N T

The prayer in this writ petition is only for granting one time settlement benefit to the petitioner. The loan availed by the petitioner about 12 years back was only Rs. 12 lakhs. The grievance of the petitioner is that on account of accumulation of interest the loan amount was gone up to Rs. 80 lakhs and above. Since the claim of the petitioner is only for one time settlement benefit, the writ petition is disposed of with a direction to the petitioner to deposit 10% of the outstanding amount within one month from now and to comply with the directions for availing one time settlement benefit. If the petitioner makes an application along with the payment as above, reasonable time will be granted to the petitioner to settle the liability under the one time settlement scheme. Till then the auction shall be kept in abeyance for a period of one month from now and if the petitioner makes payment as above, recovery will be withheld for WPC NO. 34185/06 Page numbers payment under one time settlement scheme. However, on failure to settle the liability, the respondents can proceed with the auction. There will also be a direction to the 2nd respondent to give a detailed statement of accounts to the petitioner showing the outstanding amount for payment as above, within a week from the date of production of a copy of this judgment by the petitioner.
