S.SIRI JAGAN, JW.P.(C)NO.12369 of 2007
Dated this the 10th day of April, 2007
The petitioner wants registration of her marriage without insisting on the 30 days notice period prescribed under the Special Marriage Act. In several writ petitions, I have held that this Court cannot waive the notice period when the statute specifically prescribes that marriage can be registered only after the expiry of 30 days of the notice of marriage. This Court cannot direct the authority under the Act to waive the statutory prescription. Therefore, I do not find any merit in this writ petition, and accordingly, the same is dismissed.
