Petitioner seeks anticipatory bail on the allegation that the Ernakulam North Police are at his heels in the alleged commission of some non-bailable offences.

Learned Public Prosecutor, on instructions, submitted that the petitioner is an accused in Crime No.12/07 of Town North Police Station, Ernakulam for an offence punishable under section 420 IPC for allegedly purchasing vehicle availing loan and cheating the financial institution, that he violated the bail condition imposed by JFCM-I, Ernakulam while granting bail and that the petitioner is an accused in Crime No.32/07 of the very same police station for offences punishable under sections 406 and 420 IPC and subsequently transferred to the Central Police Station, Ernakulam, where it has been re-registered as Crime No.98/07, that the petitioner had availed of a loan of Rs.3,50,000/- from the Kerala Financial Corporation for purchasing a Santro car and he has subsequently defaulted the instalments. The learned Public Prosecutor further submitted that the petitioner is involved in two similar crimes in Thiruvananthapuram circle. BA.2050/07

3. Anticipatory bail cannot be granted in a case of this nature. I am, however, inclined to permit the petitioner to surrender before the Investigating Officer for interrogation and then to have his application for regular bail considered by the Magistrate having jurisdiction. Accordingly, the petitioner is directed to surrender before the Investigating Officer on any day between 17.4.2007 and 19.4.2007 for the purpose of interrogation. The petitioner shall, thereafter, be produced on the same day before the Magistrate having jurisdiction, who shall consider and dispose of the application for regular bail, if any, filed by the petitioner. Such disposal shall preferably be on the same date on which the application is filed. This application is disposed of as above.
