O R D E RThe petitioner, who is the first accused in Crime No.48/2007 of Pangode Police Station for offences punishable under Sections 341, 323, 324 and 308 IPC read with Section 34 IPC, seeks anticipatory bail.
2. According to the petitioner, he is a juvenile below the age of 18 years on 1.3.2007, that is the date of commission of offence and even now. If the petitioner is a juvenile then, he is not liable to be detained in prison or in police lock up. The petitioner can very well surrender before the Magistrate having jurisdiction, namely J.F.C.M-II, Nedumangadu, and satisfy the Magistrate by producing material in support of his contention that he is a juvenile.
3. The petitioner shall therefore, surrender before the said Magistrate within two weeks from today and produce the material in support of his contention that he is a juvenile. In case the Magistrate is satisfied that the petitioner is a juvenile, B.A.2149/2007 2 the Magistrate shall forward him to the C.J.M, Thiruvananthapuram, to be dealt with according to the law.
