S. SIRI JAGAN, J.W.P.(C)NO.12304 OF 2007
DATED THIS THE 10th DAY OF APRIL, 2007
The petitioner and her predecessor in interest are stated to be in possession and enjoyment of certain properties since 1963. The petitioner now apprehends dispossession on the ground that the property forms part of excess lands which are treated as excess land liable for surrender by the Taluk Land Board. In the said circumstances, the petitioner has filed a claim statement - Ext.P4 under Sections 7E and 106B of the Kerala Land Reforms Act as amended by Amendment Act in 2005. The petitioner seeks a direction to the 2nd respondent - The Taluk Land Board or any other competent authority to consider and pass orders on Ext.P4 expeditiously.
2. I have heard the learned counsel for the petitioner as also the learned Government pleader. In the facts and circumstances of the case, there would be a direction to the 2nd respondent or any other authority competent to consider Ext.P4 filed by the petitioner as expeditiously as possible, at any rate, within three months from the date of receipt of a copy of this judgment. Till final orders are passed W.P.(c)12304/07 2 on Ext.P4, the petitioner shall not be dispossessed from the property. The writ petition is disposed of as above.
