THANKACHAN v. STATE OF KERALA - Bail Appl No. 2131 of 2007 RD-KL 7474 (10 April 2007)
IN THE HIGH COURT OF KERALA AT ERNAKULAMBail Appl No. 2131 of 2007()
1. STATE OF KERALA
For Petitioner :SRI.ESM.KABEER
For Respondent :PUBLIC PROSECUTOR
The Hon'ble MR. Justice V.RAMKUMAR
O R D E R
V.RAMKUMAR, J.Bail Application No. 2131/2007 Dated this 10th day of April, 2007
O R D E RThe petitioner, who is the first accused in Crime No.19/2007 of Keezhvaipur Police Station for offences punishable under Sections 452, 341, 324 and 326 IPC read with Section 34 IPC, seeks anticipatory bail.
2. An earlier application for anticipatory bail filed by the petitioner as B.A.No.1581/2007 was disposed of by this Court directing him to surrender before the Investigating Officer on any day between 20.3.2007 and 22.3.2007 for the purpose of interrogation and thereafter directing the Magistrate to release the petitioner on bail.
3. The grievance of the petitioner is that the final report in the case had already been filed as early as on 31.1.2007 and therefore, the Investigating Officer was not entertaining his request to interrogate him. If the final report has already been filed even before the earlier order dated 13.3.2007 passed by this Court, there cannot be any investigation thereafter. B.A.2131/2007 2
4. Accordingly, if the petitioner surrenders before the Magistrate concerned and files an application for regular bail within two weeks from today, he shall be released on bail on appropriate conditions, including one ensuring his continued presence before the Court. The application is disposed of as above. V.RAMKUMAR,
