V.RAMKUMAR, J.Bail Application No. 2168/2007 Dated this 11th day of April, 2007
O R D E RThe petitioner, who is the second accused in Crime No.156/2007 of Changaramkulam Police Station for offences punishable under Sections 143, 147, 283 and 353 IPC read with Section 149 IPC, seeks anticipatory bail.
2. The learned Public Prosecutor opposed the application submitting inter alia that the petitioner is an accused in two other crimes.
3. The case of the prosecution is that at about 6.00 p.m on 22.3.2007, the petitioner along with other accused blocked the vehicles at Edappal Junction consequent on prohibiting the sale of fish and they wrongfully restrained the Sub Inspector of Police and his party from discharging their official duties.
4. Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Magistrate concerned and seek regular bail. Accordingly, if the petitioner surrenders before the B.A.2168/2007 2 Magistrate concerned and files an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same date on which it is filed.
