IN THE HIGH COURT OF KERALA AT ERNAKULAMWP(C) No. 27783 of 2006(G)
1. ALOSHIOUS, DHANYA,
1. THE I.C.I.C.I BANK,
For Petitioner :SRI.J.DEVADANAM
For Respondent :SRI.KKM.SHERIF
The Hon'ble MR. Justice R.BASANT
O R D E R
R.BASANT, JW.P(C) Nos.27783 of 2006 & 12633 of 2007
Dated this the 12th day of April, 2007
The grievance of the petitioner is that the court at Chennai which does not come under the supervisory jurisdiction of this Court under Article 227 of the Constitution or Section 482 of the Code of Criminal Procedure has taken cognizance of two offences punishable under Section 138 of the Negotiable Instruments Act against the petitioner.
2. In the light of the decision in Meenakshi Sathish v Southern Petrochemical Industries [2007(1) KLT 890], these petitions are clearly not maintainable before this Court as cognizance has been taken by a court outside the territorial jurisdiction of this Court.
3. These Writ Petitions are, in these circumstances, dismissed.
