V.RAMKUMAR, J.Bail Application No. 2191/2007 Dated this 12th day of April, 2007
O R D E RThe petitioner, who is the second accused in Crime No.1018/2005 of Neyyattinkara Police Station for offences punishable under Sections 465, 468, 470 and 420 IPC read with Section 120B IPC, seeks anticipatory bail.
2. The learned Public Prosecutor opposed the application submitting inter alia that the petitioner, who is a School Teacher, and the first accused who is also a School Teacher had by resorting to forgery, applied and obtained a loan in the name of the defacto complainant who was in the dark about the said loan.
3. Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Magistrate having jurisdiction and seek regular bail. Accordingly, if the petitioner surrenders before the Magistrate concerned and files an application for regular bail within two weeks from today, the same shall be B.A.2191/2007 2 considered and disposed of preferably on the same date on which it is filed.
