Dated this the 12th day of April, 2007

O R D E R

The petitioner, who faces allegations under Section 302 I.P.C., was directed to be released on bail by the learned Sessions Judge. Application was filed before this Court to cancel the bail. The said application was dismissed by this Court, but subject to imposition of certain stringent conditions. The said order was passed on 21.3.2007. Within a period of 20 days, the petitioner has come before this Court with the present petition with a request that the condition imposed may be modified/deleted.

2. According to the learned counsel for the petitioner, the condition that the petitioner shall not leave the jurisdiction of J.F.C.M., Alleppey hurts the petitioner most. He is not able to visit his parents. His marriage is proposed to be conducted. He is unable to live within the jurisdiction of the J.F.C.M. Alleppey. In these circumstances it is prayed that the condition that he should not leave the jurisdiction of J.F.C.M., Alleppey, may be modified. Crl.M.C.No. 1153 of 2007 2

3. The application is opposed. I have considered all the relevant inputs. I am certainly of the opinion that the purpose for which the said condition was imposed continues unabated and it is not necessary at this early stage to consider deletion of the condition.

4. This Crl.M.C. is accordingly dismissed. (R. BASANT) Judge tm
