The petitioner who is the first accused in Crime No.91/2007 of Kottakkal Police Station for offences punishable under Sections 143, 147, 188 and 163-A IPC read with Section 149 IPC, seeks his enlargement on bail.

2. The learned Public Prosecutor opposed the application.

3. The case of the prosecution is that at about 12.15 p.m on 19.3.2007, about 30 activists of NDF were leading a procession shouting slogans against the judgments of the High Court and promoting communal enimity. The petitioner was arrested on the same day, namely 19.3.2007.

4. Having regard to the nature of the offences and the other circumstances of the case, I am inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on his executing a bond for Rs. 10,000/- (Rupees ten thousand only) with two solvent sureties each for the like amount to the satisfaction of the J.F.C.M, Malappuram and subject to the following conditions: B.A.2270/2007 2

(a). The petitioner shall report before the Superintendent of Police, Malappuram between 9 am. and 11 am. on all Wednesdays.

(b). The petitioner shall not enter the limits of Kottakkal police station until further orders.

(c). The petitioner shall not influence or intimidate the prosecution witnesses nor shall he attempt to tamper with the evidence for the prosecution.

(d). The petitioner shall not commit any offence while on bail.

5. If the petitioner commits breach of any of the above conditions, the bail granted to him shall be liable to be cancelled. The application is allowed as above. V.RAMKUMAR,
