O R D E RPetitioner is the 4th accused in Crime No.200/01 of the Manjeswar Police Station, registered under Sections 143, 148, 341, 323, 324, 506 (1) read with 149 of the IPC. There were 10 accused persons in the case. The case against the petitioner was split up as LP case 137/2006. The case against other accused was proceeded with in CC No. 01/2002 and all of them were acquitted. The case against the petitioner is refiled as CC No. 587/2006. It is stated in the memorandum of Crl.MC that the case was settled between the parties even earlier and all the accused were acquitted in view of this settlement of the case. It is stated that the petitioner was employed elsewhere. Non-bailable warrant is issued against the petitioner now.
2. In the facts and circumstances of the case, there will be a direction to the Chief Judicial Magistrate, Kasaragod to consider the Bail Application, if any, submitted by the petitioner on his surrender before that Court and to dispose of such bail application Crl.M.C. 1237/2007 -Page numbers- on the same date on which it is filed. The learned Chief Judicial Magistrate shall take note of the acquittal of the other accused and dispose of the application accordingly. This Crl.M.C. is disposed of as above.
