This Writ Appeal is filed against the interim order passed by the learned single Judge vacating the interim order stay enabling the additional fourth respondent to continue the sand mining in terms of the licence granted. The learned counsel for the appellant/petitioner submitted that the observation in the interim order to the effect that the opposition by the petitioner was without any bonafides was uncalled for.

2. That is only an observation made at the preliminary stage and we are sure that the said observation will not stand in the way of disposal of the writ petition on merit. This appeal is accordingly dismissed. V.RAMKUMAR,
