Dated this the 23rd day of May, 2007

O R D E R

Petitioners, six in number, seek anticipatory bail on the allegation that the Kanjikuzhi police are at their heels in connection with Crime No.67/07 of the said police station for offences punishable under sections 353, 220 and 225 read with section 34 IPC and section 55(i) of the Abkari Act.

2. Learned Public Prosecutor submitted that the petitioners 1, 2, 5 and 6 are respectively accused Nos.3, 1, 7 and 6 and petitioners 3 and 4 are not accused in the case. He also submitted that the offences attracted against the aforementioned petitioners are those punishable under the Indian Penal Code.

3. Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioners should not surrender before the Magistrate concerned and seek regular bail. Accordingly, if the petitioners 1, 2, 5 and 6 surrender before the Magistrate concerned and file an application for regular bail within two weeks from today, the same shall be considered and disposed of, preferably on the same date on which it is filed. This application is disposed of as above.
