The petitioner, who is the first accused in Crime No.180/2007 of Kadakkal Police Station for offences punishable under Sections 143, 147, 364B and 120B IPC read with Section 149 IPC, seek anticipatory bail.2. The case of the prosecution is that one Nisar was kidnapped by seven gundas allegedly hired by the petitioner on 19.4.2007 and after keeping him in captivity, a sum of rupees Three Lakhs was demanded from Shajahan, the brother of the said Nisar, by way of ransom and the detenue was brutally manhandled.
3. Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Magistrate concerned and seek regular bail. Accordingly, if the petitioner surrenders before the Magistrate concerned and files an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same date on which it is filed.
