ORDER

Petitioners, who are accused Nos. 3,7,8 and 10 to 12 in Crime No.405 of 2006 of Puthunagaram Police Station for offences punishable under Sections 143, 147, 148, 341,323, 324 and 307 read with Section 149 I.P.C., seek anticipatory bail.

2. The occurrence took place at 9.30 p.m. on 27.12.2006 in which the de facto complainant had sustained one head injury and another injury on his shoulder. Weapons like sword and stick were used.

3. The learned public Prosecutor opposed the application.

4. Anticipatory bail cannot be granted in a case of this nature. At the same time, I am inclined to give the petitioners an opportunity to surrender before the Investigating Officer and get their application for regular bail considered by the Magistrate. Accordingly, the petitioners shall surrender before the Investigating Officer any day between 15.1.2007 and 18.1.2007 for the purpose of interrogation. After interrogation, the petitioners shall be produced before the  BA 117/07 -: 2 :- Magistrate on the same day. The Magistrate shall consider and dispose of the application, if any, filed by the petitioners for regular bail. Such consideration and disposal shall be done preferably on the same date on which such application for regular bail is filed. This petition is disposed of with the above direction.
