O R D E RThe petitioner who is the first accused in Crime No.321/2007 of Vadakara Police Station for offences punishable under Sections 143, 147, 148, 324 and 307 IPC read with Section 149 IPC and also under Section 3 and 5 of the Explosive Substance Act, seeks his enlargement on bail. The occurrence took place on 8.30 p.m., on 16.4.2007 in which three persons were injured by the blast of country bombs. The petitioner was arrested on 25.4.2007.
2. The learned Public Prosecutor opposed the application submitting inter alia that the petitioner is an accused in two other crimes. Hence the case of the petitioner cannot be treated on the same par with accused Nos. 2 and 4 in the case who had been granted bail.
3. Having regard to the nature of the offences, the duration of judicial custody of the petitioner, the present stage of investigation of the case and the other circumstances of the case, if the petitioner is released on bail, he will definitely B.A.No.3214/2007 2 influence and intimidate the prosecution witnesses. There is also the likelihood of the petitioner making himself scarce and fleeing from justice. I am, therefore, not inclined to grant bail to the petitioner at this stage.
