Dated this the 6th day of June, 2007

O R D E R

The petitioner faces allegations under Section 420 I.P.C. He had obtained anticipatory bail from this Court. The directions were to remain in force for a period of one month. Conditions were imposed. Within the period of one month, the petitioner had to appear before the learned Magistrate and seek regular bail. Regular bail has been granted also, it is submitted. The petitioner has come to this Court now for deletion of the conditions imposed in the anticipatory bail order dt. 20.3.2007.

2. Are those conditions in force now? Those conditions were supposed to remain for a period of one month, within which time the petitioner had to seek regular bail from the learned Magistrate. If he has sought regular bail and obtained the same subject to conditions, if any, there can be no question of this Court modifying the conditions of anticipatory bail. The anticipatory bail order does not live longer than the one month specified in the order. If the learned Magistrate has imposed any condition, it is for the petitioner to 2 appear before the learned Magistrate and seek modification of the conditions imposed.

3. This Crl.M.C. is dismissed with the above observations. (R. BASANT) Judge tm
