O R D E RThe revision petitioner stands convicted for the offence under Section 279 IPC and sentenced, as modified by the appellate court, to undergo simple imprisonment for one month and to pay a fine of Rs.1,000/- and in default to undergo simple imprisonment for 15 days.
2. The counsel for the revision petitioner has only sought for modification of sentence. It is pointed out that the incident had taken place in the year 1998 and that nobody has been injured in the accident. In the circumstances, the sentence is modified to imprisonment till the rising of the court and to pay a fine of Rs.1,000/- and in default to undergo simple imprisonment for 15 days. The revision petitioner shall appear before Judicial First Class Magistrate-II, Palakkad on 10.07.2007 to receive sentence. The Crl.R.P is disposed of accordingly.
