M.N.KRISHNAN, J.W.P.(C) No.10841 of 2007 N
Dated this the 8th day of June, 2007.
This writ petition is filed for a direction to the Principal Subordinate Judge's Court, Thiruvananthapuram to consider and pass orders on Exts.P1 and P2 petitions filed by the petitioner before proceeding further with the trial of O.S.No.217/2001.
2. Learned counsel for the writ petitioner submits that the matter is even now pending. Ext.P1 is an application to send the signature for comparison and get an expert report and Ext.P2 is an application to advance the hearing date of the case. Since the party has moved two applications which are necessarily to be considered before the trial commences, the Principal Subordinate Judge, Thiruvananthapuram is directed to consider Exts.P1 and P2 applications after giving notice to the other side, within a period of four weeks from today and thereafter proceed with the trial in accordance with law. Writ petition is disposed of as above. Sd/- (M.N.KRISHNAN)
