CHAMPALAL v BOARD OF REVENUE & ORS - CW Case No. 2114 of 2004 [2004] RD-RJ 176 (16 August 2004)
S. B. C. W. P. NO.2114/04
(Champalal Vs. Board of Revenue & Ors.)
DATE OF ORDER : 16.08.2004
HON'BLE SHRI N.P.GUPTA,J.
Mr.D.R.Bhandari for the petitioner.
Heard learned counsel for the petitioner, and perused the documents annexed with the writ petition.
Learned Revenue Appellate Authority, and the Board of Revenue have positively found the fact that the possession of the defendant was since the year 1973. Not only this, even in second appeal, the Board of Revenue has reappreciated the evidence thread bare, and thereafter has come to the aforesaid finding, and in that view of the matter, the theory propounded by the writ petitioner about trespass having been committed in the year 1980 and the accrual of the cause of action in the year 1997 has been disbelieved. I do not find any sufficient ground to interfere with the findings of fact.
The writ petition is, therefore, dismissed summarily.
