82 S.B.Civil Writ Petition No.1208/2004

Date of Order : 22-07-2004

HON'BLE MR. N.P.GUPTA,J.

Mr.K.C.Samdariya, for the petitioner.

Nobody appears on behalf of respondents despite service. As such, I have heard learned counsel for the petitioner on the stay application.

Pending disposal of the writ petition, it is directed that operation of impugned order, so far as ,it holds the document to be inadmissible in evidence for want of registration, shall remain stayed, inasmuch as the learned court shall receive the document in evidence, subject to sufficiency of stamp. However, this admission of document in evidence, in absence of registration, shall be subject to the decision of the present writ petition. The trial court is further directed to expeditiously proceed with the trial of the suit.

(N.P.GUPTA),J.
