CHOTU RAM v A.D.J.,MERTA CITY & ORS - CW Case No. 1621 of 2004 [2004] RD-RJ 33 (23 July 2004)

S.B.CIVIL WRIT PETITION NO. 1621/2004

Date of order: 29.7.2004

HON'BLE MR. JUSTICE N.P.GUPTA

Mr. S.D.Purohit, for the petitioner.

Mr. O.P.Joshi, for the respondents.

Heard learned counsel for the parties.

I do not find any sufficient ground to interfere with the impugned order in my writ jurisdiction. However, it is made clear that if necessity so arises, and if the petitioner so stands advised, it will be open to the petitioner to challenge the correctness, legality, or propriety of the impugned order by setting forth appropriate ground in the memo of appeal.

The writ petition is accordingly dismissed with the aforesaid liberty.

(N.P.GUPTA), J.
