RAJU v STATE & ORS. - CW Case No. 4002 of 2004 [2004] RD-RJ 378 (6 October 2004)

IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR

--------------------------------------------------------

CIVIL WRITS No. 4002 of 2004

RAJU

V/S

STATE & ORS.

Mr. MANOJ BHANDARI, for the appellant / petitioner

Date of Order : 6.10.2004

HON'BLE SHRI N P GUPTA,J.

ORDER

-----

Heard learned counsel for the petitioner.

It is not in dispute that at the time of death of the deceased employee, one of his sons was in employment. In that view of the matter, simply because subsequently that son expired, it cannot be said that petitioner re-acquired entitlement to get appointment on compassionate ground.

In that view of the matter, I do not find any error in Annex.6, nor do I find any sufficient ground to invoke my writ jurisdiction in favour of the petitioner. The writ petition is, therefore, dismissed summarily.
