By these three writ petitions, a common questions for providing sitting facilities to the lawyers and attestation of documents by the Notaries is being disposed of in relation to the
R.T.O. Office. As regards the question of sitting facility of the lawyers in the premises of Regional Transport Office, an appropriate place has been earmarked. The Officers of Regional
Transport are present in the court and the lawyers are satisfied with the earmarked place. Therefore, there is no grievance in this regard.
As regards the attestation of documents by the Notary
Public in RTO Office an order was passed by the Transport
Commissioner restraining the Notaries to attest the documents in relation to verification of age and address. Pursuant to the order of this court dt.16.4.2004 the Transport Commissioner passed an order that the Department will receive such attested documents from the present Notaries verifying the age and address. The rules framed in the Notaries Act authorise such attestations. The earlier order appears to be passed keeping in view the Rules of the Motor Vehicles Act. Now an order has been made to relax the same. If at all any order is passed in future where right of the Public Notaries is to be taken away by the order of the Commissioner, Transport, State of Rajasthan, this court will be apprised and permission will be sought from this
