Heard learned counsel for the petitioner and learned Public Prosecutor for the
State. Perused the order impugned and the challan papers.
The allegation against the petitioner is that he committed rape of a girl namely
Maya aged about 14 years.
Having regard to the facts and circumstances of the case, I do not think it a fit case to grant bail to the petitioner. Accordingly, the bail application filed by the petitioner Lalit @ Laxman under Sec. 439 Cr.P.C is hereby rejected. However, the petitioner is at liberty to file fresh bail application after the statement of prosecutrix Maya is recorded by the trial court. The trial court shall record the statement of prosecutrix as first witness.
