NAND LAL v SHYAM SUNDER & ORS. - CW Case No. 5225 of 2004 [2004] RD-RJ 639 (7 December 2004)
S.B. Civil Writ Petition NO.5225/2004
Nand Lal Vs. Shyam Sunder & Ors.
Date of Order : 07-12-2004
HON'BLE MR. PRAKASH TATIA,J.
Mr. S.G. Ojha,for the petitioner.
The only relief sought by the petitioner in this writ petition is that because of the interim order passed by the trial Court, the petitioner is facing great hardship, therefore, the court below may be directed to decide the petitioner's application for injunction expeditiously.
It appears that petitioner submitted before the trial Court an application dated 28.9.2004 and requested that he may be permitted to use the shop in question.
Since, it is a short prayer of the petitioner seeking only relief of early hearing of the application for injunction, therefore, this
Court deems no necessity of issuing any notice to the respondent and it is ordered that the trial
Court may decide the injunction application expeditiously within a period of three weeks from the date of submitting the copy of this order before the trial Court.
Therefore, the writ petition is disposed of. [PRAKASH TATIA],J.
