GANESHA RAM v STATE & ORS - CW Case No. 3122 of 2004 RD-RJ 65 (28 July 2004)
S. B. C. W. P. NO.3122/04
(Ganesha Ram Vs. State of Raj. & Ors.)
DATE OF ORDER : 28.07.2004
HON'BLE SHRI N.P.GUPTA,J.
Mr.Hemant Choudhary for the petitioner.
Heard learned counsel for the petitioner.
I do not find any error in the order of the Board of Revenue accepting the revision against the order of the Revenue Appellate Authority, Annexure-9, whreby the review petition was allowed, and the order deciding the appeal being Annexure-7 was set aside.
The Revenue Board has rightly found that there was no sufficient ground for review. The submissions sought to be made by the learned counsel for the petitioner before me rather shows that the review was calculated to have a rehearing of the appeal on merits itself, and as appears from Annexure-9, that this precisely was done by the Revenue Appellate
Authority. As such, the writ petition has no force and is hereby dismissed summarily.
