SB. CRIMINAL MISC. PETITION NO. 1035/2004

Date : 14.12.2004

Mr. G.L.Khatri for the petitioner.

Mr. O.P.Rathi, P.P.

Mr. Shanker Singh for the non-petitioner = == = = =

Heard.

The issue origins out of matrimonial ties. The Courts below have refused to record the compromise in accordance with Section 320 Cr.P.C.

May be no illegality has been committed by the trial court. However, the stage the case is only where cognizance has been taken. Charges have so far not been framed. At the time the Court considers the question of framing charges, it would also consider that the parties have compromised. The trial may not be of any consequence in the matter, therefore pass appropriate orders.

The misc. petition is disposed of.
