Heard learned counsel for the petitioner.

I do not find any sufficient ground to have been made out for restoration of appeal.

The appeal was filed on 29.1.2003, and since then defects have not been removed. The appeal was listed on 17.11.03, on which date, in presence of learned counsel, defects were directed to be removed within 2 weeks and per-emptry order was passed. From a perusal of application for restoration, it is clear that petitioner has not been able to make out any sufficient ground for non-compliance of the order. The restoration application is, therefore, dismissed.
