Learned counsel for the petitioner submits that in identical matters, vide order dt. 20.4.2004, the appellate judgment dt. 7.11.03 was set aside, and the matter was remanded back to the respondent no.2 with the directions given therein. It is also informed that pursuant to that remand, the respondent no.2, the S.T.A.T., has again decided the matter.

In that view of the matter, since the order dt.7.11.03 no more survives qua the petitioner, the writ petition becomes infructuous, and the same is, therefore, dismissed as infructuous.
