BHANWAR LAL v STATE & ANR. - CW Case No. 4180 of 2005 [2005] RD-RJ 1161 (18 July 2005)

S.B. CIVIL WRIT PETITION NO.4180/2005

Bhanwar Lal Vs. The State of Rajasthan and another.

Date : 18.7.2005

HON'BLE MR. PRAKASH TATIA, J.

Mr. Pradeep Choudhary, for the petitioner.

Mr. LR Upadhyay, Dy.GA, for the respondents.

-----

Learned Dy. Govt. Advocate is directed to accept notice on behalf of the respondents. Copy of writ petition is supplied to him.

Heard learned counsel for the parties.

The petitioner apprehends that in view of the

Government order dated 6.3.2003, the respondents may change the revenue entry without giving an opportunity of hearing to the petitioner.

It appears that large number of entries have been changed only by following the State Government's order dated 6.3.2003 and those orders of changing the revenue entries have been set aside by this Court in various writ petitions.

In view of the above, the writ petition of the petitioner is disposed of with a direction to the respondents not to change the revenue entries which are in existence today without affording an opportunity of hearing to the khatedar tenants in whose name the revenue entries are standing.
