JAN MOHAMMED v STATE & ORS - CW Case No. 1875 of 2003 RD-RJ 125 (17 January 2005)
S.B. Civil Writ Petition No.1875/2003
Date : 17.01.2005
Hon'ble Mr. Justice R.P.Vyas
Mr.L.D. Khatri for petitioner.
Mr.R.Dave, Dy.G.A. for the State-respondents.
The instant petition has been filed by the petitioner praying, inter alia, therein that the respondents may be directed to comply with the award dated 30th April, 2002 (Annexure-1) passed by the
Labour Court, Jodhpur, immediately and benefits arising out of the said award may be ordered to be given to the petitioner.
Learned counsel for the petitioner submits that the award dated 30th April, 2002, has not been complied with the respondent-authority till today and the award has been passed way back in the year 2002. It is categorically proved that award dated 30th April, 2002, has not been complied with till today.
The above fact has not been controverted by the learned Deputy Government Advocate Mr.R.Dave.
In view of the facts and circumstances of the case, in the interest of justice, I deem it just and proper to direct the respondents-Authority to comply with the award dated 30th April, 2002 passed in Labour
Dispute Case No.135/1997 within a period of three months from the date of receipt of certified copy of this order strictly in accordance with the observations made in the said award.
With these observations and directions, the instant writ petition stands disposed of.
