GURBACHAN SINGH & ORS v MITHA SINGH & ORS - CSA Case No. 125 of 2004 [2005] RD-RJ 1278 (4 August 2005)

S.B.Civil Second Appeal No.125/2004

Gurbachan Singh & Ors. vs. Mitha Singh & Ors.

Date : 4.8.2005

HON'BLE MR. PRAKASH TATIA, J.

Mr. Kishan Bansal, for the appellant.

Mr. KS Gill, for the respondent.

-----

Heard learned counsel for the parties.

After going through the findings recorded in the two judgments whereby both the courts below concurrently found that Pakar Singh had right to bequeath his share in property by will and he in fact, executed the second will in favour of the defendants, I do not find that the courts below committed any illegality. In view of the above finding of fact, the courts below were right in dismissing the suit of the plaintiff.

No substantial question of law is involved in this appeal. Hence, this second appeal is dismissed.

(PRAKASH TATIA), J.
