STATE & ORS v KANHAIYALAL & ORS - CR Case No. 13 of 2005 [2005] RD-RJ 137 (17 January 2005)

IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR

--------------------------------------------------------

CIV. CONTEMPT PET. No. 13 of 2005

LAL CHAND

V/S

MST. RAMI DEVI

Mr. KISHAN BANSAL, for the appellant / petitioner

Date of Order : 7.7.2006

HON'BLE SHRI N P GUPTA,J.

ORDER

-----

Heard learned counsel for the petitioner.

The interim order of this Court was only restraining the respondent Rami Devi from alienating the property. There was no such order prohibiting Tehsildar cum

Sub Registrar not to register any document, if presented.

In that view of the matter, I do not find any sufficient ground to allow the application so as to initiate proceedings for contempt against Balram the then Sub

Registrar cum Tehsildar. The application is, therefore, dismissed. The contemner against whom proceedings were initiated being Rami Devi has already expired. As such, the contempt proceedings no more survive, and are, therefore, dropped.
