INDRA RAM CHAUDHARY & ANR. v STATE & ANR. - CW Case No. 6894 of 2005 [2005] RD-RJ 1599 (2 December 2005)

SBCivil Writ Petition No.6894/2005

Indra Ram Choudhary & Anr. v. State of Raj.& Anr. 2nd December, 2005

Date of Order ::

HON'BLE MR.JUSTICE GOVIND MATHUR

Mrs.Nupur Bhati, for the petitioners. ....

The grievance ventilated by the petitioners by instant writ petition is that the respondents are proceeding to construct a road on a play ground situated between two schools in village Singhana,

Tehsil Deedwana, District Nagaur.

It is contended that in village Singhana adjoining to Deedwana Ladnu road, Rajasthan Higher

Secondary School is situated. A primary school is also situated in village and in between these two schools a huge field is lying vacant which is used by the students of these schools as play ground. The respondents under "Pradhaanmantri Gram Sadak Yojna" are proceeding to construct a road passing through the play ground, reference of which is given above.

The apprehension of the petitioners is that the construction of road from the play ground will not only obstruct sports and other extra curriculum activities of the students but shall also be a traffic hazard. The petitioners have also made a reference of a suitable alternative road which may be used for the purpose required to be obtained by constructing the road proposed.

Before approaching this Court the petitioners have given representations to Hon'ble Ministers of

Government of Rajasthan. A short representation was also given to the Additional Collector, Deedwana.

In totality of facts of the case I consider it appropriate to direct the petitioners to submit a detailed representation ventilating their grievance to the Collector, Nagaur through the Additional

Collector, Deedwana on or before 12.12.2005. The

Collector, Nagaur thereafter shall decide the representation by considering all the contentions raised by the petitioners in the representation on or before 19.12.2005. Till disposal of such representation the respondent No.2 i.e. the Executive

Engineer, Public Works Department, Deedwana shall not proceed with the construction of road proposed.

With the directions above the writ petition stands disposed of.
