Learned counsel for the appellant submits that the appeal has become infructuous for the reason that possession of disputed property has already been taken by plaintiff-respondent, therefore, he does not to continue the appeal and wants to withdraw the same. Learned counsel for the respondents has no objection to it.

The appeal stands dismissed as withdrawn.
