The present controversy in the instant petition is squarely covered by the decision of this court rendered in S.B. Civil Writ Petition No. 642/2004
(Prathvi Singh V/s State and Anr.), decided on 11.3.2004.
I have heard learned counsel for the parties.
This fact regarding the subject-matter in controversy, covered under the said judgment, is not opposed by Ms.R.R.Kanwar, learned Addl. Govt.
Advocate. It is submitted by the learned counsel that the petitioner has submitted the certificate of Scout Training (Annex.-4), but his candidature has not been considered.
In view of the aforesaid admitted position, the writ petition is allowed and the respondents are directed to give appropriate bonus marks on the basis of Annexure-4 for the purpose of considering the petitioner's candidature for appointment to the post of teacher Gr.III. The respondents will consider the candidature of the petitioner if it is found that the certificate is a genuine.
In view of the above, the petition stands disposed of.
