Heard learned counsel for the petitioners and the Public
Prosecutor. Perused the order impugned as well as the police investigation diary. I have carefully gone through the statement of Ramchandra recorded under section 161 Cr.P.C., who is said to be an eye-witness of the occurrence. He stated that the present petitioner and one Gulab slaughtered the cow and distributed its meat. Gulab was arrested by the police.
In view of the statement of the eye-witness, it cannot be said that the present petitioners are not involved in the alleged commission of crime.
In the circumstances, therefore, it is not a fit case to grant anticipatory bail to the petitioners. The bail application filed by petitioners under section 438 Cr.P.C. is, therefore, rejected.
