Heard learned counsel for the petitioner.
The petitioner submitted an application for transfer of civil appeal no.1/2004 to any other court from the Court of Addl. District
Judge (Fast Track), Parbatsar.
According to petitioner, the friends and the colleagues of the respondents Brijlal and Ramnarayan are living near the house of the
Presiding Officer of the court and the respondents' earlier advocate is now posted as a Public Prosecutor in the court of Addl. District Judge
(Fast Track), therefore, the petitioner has apprehension that he will not get the justice from the Presiding Officer. According to learned counsel for the petitioner, the petitioner's apprehension finds support from the fact that petitioner's two applications were dismissed by the appellate court.
I considered the submissions of learned counsel for the petitioner.
It is clear from the facts mentioned in the application for transfer of the appeal itself that the allegations are absolute vague and cannot be a ground for transfer of the case.
In view of the above, I do not find any merit in this writ petition and the same is hereby dismissed.
