Learned counsel for the petitioner submits that temporary injunction application itself has been decided on merits on 11.3.05.

In that view of the matter, the present writ petition becomes infructuous. However, it is made clear that this order of dismissal of writ petition, will not come in the way of petitioner, in case the order impugned in the writ petition, is required to be challenged at any subsequent stage.
