Heard learned counsel for the appellant and perused the order of the learned Single Judge dated 12.08.2004, dismissing the writ petition.
The Labour Court, Sri Ganganagar, on appreciation of material on record found the termination order of the respondent workman namely Jodharam illegal being violation of provisions of the Industrial Disputes Act. Thus, he made an award of reinstatement with 30% back wages.
It is contended by the learned counsel that the labour court has failed to consider in right perspective that the respondent workman had not actually worked for more than 240 days. We have perused the judgment of the labour court. There is an admission of the Executive Engineer vide Exhibit-1 to the effect that the respondent work man Jodha Ram was called for interview and selected in regular way. He worked for more than two years. The said finding has been confirmed by the learned
No interference is warranted with the order of the learned Single Judge.
The special appeal stands dismissed.
