We have heard learned counsel for the appellant and perused the order of the learned Single Judge dated 17.01.2005.
The appellant was admitted to the MBA course 2002 with the second respondent Director, Management and
Commerce Institute of Global Sinergy, Lohagal Panchsheel Link
Road, Ajmer. He cleared the first year MBA examination 2002- 2003. In the second year MBA examination he was not allowed to appear in the examination in the year 2004 on account of shortage of attendance. He was denied admission to the second year MBA examination for the sessions 2004-2005 as a regular student. The last date for depositing the examination fee as a private student was 22.12.2004. He did not deposit the examination fee for appearing as a private student on the ground that the fee deposited for the examination 2004 should be stand carried forward for examination 2005. This plea was not accepted by the respondents. It appears from the record that the appellant neither attended the classes for the entire session 2003-2004 nor he deposited the fee for the examination 2005.
In these circumstances of the case, he has rightly not been allowed to appear in the examination 2005 as a private student.
No interference is warranted with the order of the learned Single Judge.
The special appeal stands dismissed.
